1. Acceptance of Terms

By accessing or using Petfolio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

Petfolio is a pet care tracking application that allows you to:

  • Store and manage pet profiles, photos, and information
  • Track meals, medications, and health records
  • Set reminders for pet care activities
  • Share pet information with family members, pet sitters, and veterinarians
  • Create timelines and memories of your pet's life

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Subscription and Payment

4.1 Free and Pro Plans

Petfolio offers both free and paid subscription plans. The features available under each plan are described on our pricing page and may be updated from time to time.

4.2 Payment Terms

  • Pro subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • We use third-party payment processors and do not store your payment information
  • You authorize us to charge your payment method for all fees incurred

4.3 Cancellation and Refunds

You may cancel your Pro subscription at any time. Upon cancellation:

  • You will retain Pro access until the end of your current billing period
  • Your account will automatically convert to the Free plan
  • No refunds will be provided for partial billing periods
  • Your data will be retained but may be subject to Free plan limitations

5. User Content and Conduct

5.1 Your Content

You retain all rights to the content you upload to Petfolio (photos, notes, records, etc.). By uploading content, you grant us a limited license to:

  • Store, process, and display your content as necessary to provide the Service
  • Create backups and perform technical operations
  • Share your content with users you explicitly authorize (family members, pet sitters, etc.)

5.2 Prohibited Conduct

You agree not to:

  • Upload illegal, harmful, threatening, abusive, or otherwise objectionable content
  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Upload viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots, scrapers) without our permission
  • Interfere with or disrupt the Service
  • Impersonate any person or entity

6. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding user content), is owned by Petfolio and protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, distribute, or create derivative works of the Service
  • Reverse engineer or attempt to extract source code
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use our trademarks without written permission

7. Medical Disclaimer

PETFOLIO IS NOT A SUBSTITUTE FOR PROFESSIONAL VETERINARY CARE.

The Service is designed to help you organize pet care information, but should not be relied upon for medical decisions. Always consult with a licensed veterinarian for:

  • Medical diagnosis and treatment
  • Medication dosages and schedules
  • Emergency care
  • Health advice for your pet

8. Data Backup and Loss

While we implement regular backups and security measures, we are not responsible for any loss of data due to:

  • Technical failures or outages
  • User error or account deletion
  • Security breaches beyond our control
  • Third-party service failures

We strongly recommend maintaining your own backup copies of important pet records and documents.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the Service will be:

  • Uninterrupted, timely, secure, or error-free
  • Free from viruses or other harmful components
  • Accurate, reliable, or correct

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETFOLIO SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages arising from your use or inability to use the Service
  • Unauthorized access to or alteration of your content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Petfolio, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any content you upload to the Service

11. Termination

We may terminate or suspend your account and access to the Service:

  • For violation of these Terms
  • For fraudulent, harmful, or illegal activity
  • At our discretion for any reason with reasonable notice

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data within 30 days of termination.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the United States and the State of [Your State], without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if they qualify.

  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our control
